OFFICIAL APPEAL ON LEGISLATIVE REGULATION OF MILITARY CONSULTING ACTIVITIES IN UKRAINE

Colleagues, brothers! The current geopolitical situation all over the world, hybrid and local military conflicts has stipulated the need to legalize entities that provide military consulting services.

During four years of the anti-terrorist operation in Ukraine caused by the Russian Federation aggression it has become possible to train highly professional specialists in the military sphere. Today, according to the Ministry of Veterans Affairs official data there are almost 370,000 registered combatants in Ukraine. In order to ensure further proper application of their special knowledge, official employment and their material support there is a need for legislative regulation of the military consulting activities.

Military consulting services do not include combat operations and the use of weapons within the foreign countries territory but are the exclusively an intellectual product in the military sphere.

Countries such as the United States, the Republic of South Africa, the United Kingdom, Germany, Switzerland, and the People's Republic of China have adopted relevant regulations governing the activities of economic entities that provide military consulting services. Instead, this type of consulting business is an unresolved issue in Ukraine.

Thus, there is a loss of Ukrainian personnel to the foreign private military companies, which braking the norms of international law involve our specialists not only to the consulting activities but also to the full-scale military operations. In addition, a number of public organizations and business entities in Ukraine already provide almost military consulting services. The activities of these entities require legal regulation and state control.

The SEAL Center has become involved in to the issue of legislative regulation of military consulting activities in Ukraine viz. to participate the working group on editing the draft Law of Ukraine on military consulting activities (№ 3005 d.d. 04.02.2020):
